Everton: Nottingham Forest super silk Nick De Marco reacts to latest ‘interesting’ Toffees case
Nick De Marco has congratulated the lawyers for Everton and the Premier League for being involved in “such an interesting case”.
The so-called super silk [i News, 24 January] reacted via Twitter on 10 April urging those in the legal profession to read up on the full written reasons, after the latest commission deducted the Toffees two more points.
As he represented Nottingham Forest in their own profit and sustainability case, which saw the club lose four points in a verdict seen as inconsistent with Everton’s heavier first punishment (six down from 10 on appeal) he could not comment directly on the most recent developments but hailed his colleagues at the hearing.
De Marco wrote: “Everton v The Premier League. Due to my own involvement in other cases, I cannot currently comment on this case other than to say well done to all of my colleagues for being involved in such an interesting case, and anyone working in this space should obviously read the full written reasons.”
Everton vs Premier League case draws legal focus
Despite the chaos and unhappiness that is being caused within football by the PSR hearings and appeals it is no-doubt seen as a goldmine for the lawyers who are representing either side in each case.
The fact that the system is set up to deal with breaches as individual legal cases, with different representatives arguing in front of new panels while attempting to draw on precedent from previous hearings has created something of a confused mess within the top flight, when a clear set of rules and sanctions may have avoided that.
Forest were themselves unhappy with the imposition of a four-point penalty, although the Toffees have been left far more perturbed by the fact that they were punished more heavily for a smaller breach, and have even now overspent by a similar amount as their rivals across two cases and ended with double the sanction.
The Premier League’s apparent delight at the cooperation shown at the City Ground is at the centre of a dispute between Everton and Richard Masters’ office over their comparatively rocky interactions.

Andy Burnham has even suggested that legal action from Goodison Park against the league could yet follow after the commission dismissed criticism of the club.
And with another hearing already lined up for the summer, which could bring further points problems for next season and even more lawsuits, and the latest Everton appeal also due before then, certain members of De Marco’s colleagues will no-doubt be congratulating themselves for landing the case a few more times yet.
