Premier League regulations dictate that clubs can sustain a maximum loss of £105 million over three seasons, equating to £35 million per campaign. However, Forest’s situation is compounded by their recent ascension from the Championship, where their maximum loss was capped at £61 million due to spending two seasons in the lower division.

The influx of 26 new players totaling over £160 million in expenditures following their promotion in May 2022, coupled with minimal returns from player sales, underscores Forest’s financial mismanagement during the assessment period. To defend their case, the club enlisted prominent sports lawyer Nick De Marco, focusing their argument on the timing of Brennan Johnson’s transfer to Tottenham after the accounting deadline. The subsequent sale, valued at more than £45 million, was justified by Forest as a strategic move to secure a higher fee than if completed before the deadline.
